            The Mayor and City Council of Cumberland, Maryland, met in Regular Session on Tuesday, October 4, 2005, in the Council Chambers of City Hall.   Mayor Fiedler called the meeting to order at 7:38 P.M.

 

 

INVOCATION –  The “Lord’s Prayer” was recited.

PLEDGE OF ALLEGIANCE TO THE FLAG OF THE UNITED STATES

CALL OF ROLL:

            Present: Mayor Fiedler, Councilmen Elliott, Hedrick, Hendershot, and Rephann.  Department Heads and/or Officials present were Jeffrey E. Repp, City Administrator; H. Jack Price, Jr., City Solicitor; Jeff Rhodes, Director of Administrative Services; Kevin Hagerich, Director of Public Works; William Herbaugh, Fire Chief; and Sharon Clark, City Clerk.

 

MINUTES:

A motion was made by Councilman Elliott, seconded by Councilman Hedrick, and unanimously adopted to accept the minutes of the Work Session of August 23, 2005.

 

REPORTS:

Routine:

 

            1.  Personnel Activity report submitted by April Howser, Human Resource Officer, for the period September 18 – October 1, 2005.

            2.      Fire Department Report submitted by Chief William Herbaugh for the month of August, 2005.

            2.      Report of Code Enforcement submitted by Jeffrey Rhodes, Director of Administrative Services, for the period September 16-30, 2005.

            Councilman Hendershot made a motion to accept the reports. Councilman Hedrick seconded the motion, and the vote unanimously carried.

 

 

RESOLUTIONS:

            A Resolution was introduced and read in Title only, resolving that the National Incident Management System (NIMS) will become the City of Cumberland’s Incident Management System.  Councilman Elliott made a motion to adopt the Resolution.  Councilman Hendershot seconded the motion after which Mr. Repp provided an overview of the NIMS System which is intended to provide a consistent nationwide template to enable federal, state and local governments, as well as private-sector and non-governmental organizations to work together to prepare for, respond to, and recover from domestic incidents.

Mayor Fiedler asked for comments.  Being none, he called for the vote and the Resolution was unanimously adopted.

           

ORDERS:

 

            Consent Agenda:

 

             Mayor Fiedler advised that there were three (3) items on the consent agenda.  As there were no requests to handle items separately, Councilman Elliott made a motion to adopt the Consent Agenda.  Councilman Hendershot seconded the motion and the following Orders were unanimously adopted:

Order 24,263    Authorizing the Mayor to execute an Encroachment Agreement between the City of Cumberland and David McCagh regarding right-of-way on Bedford Street for the purpose of creating a handicap access into the building.

 

Order 24,264    Authorizing the Cumberland Fire Chie to execute a grant agreement between the Cumberland Fire Department and the Maryland Institute for Emergency Medical Services Systems - $ 11,040.00

 

Order 24,265    Authorizing the City Administrator to execute documents between the City of Cumberland and Sun Trust Leasing Corporation for financing of vehicles and equipment for a five-year term at 3.59% for a total of $ 651,501.00.

 

 

Letters, Petitions, Applications, Proclamations, Etc.

 

            Proclamation:

 

            A proclamation designating the week of October 9 – 15, 2005 as “Fire Prevention Week” was presented and read.  Councilman Hendershot made a motion to accept the proclamation.  Councilman Hedrick seconded and the motion passed unanimously.  William Herbaugh, Fire Chief for the City of Cumberland, accepted the proclamation on behalf of the department and stressed the importance of the 2005 theme to use candles with care. 

            Letters:

 

            1.      From the Maryland Department of Housing and Community Development advising that the Governor’s Consulting Committee has recommended nomination for the Rolling Mill Historic District to the National Register.
