MINUTES


 

December 8, 2011


 

 


 

 


 

The Downtown Development Commission met in regular session on this date, Thursday, December 8, 2011, in the second floor conference room at City Hall.


 

 


 

Commission members present: Chairman Dave Romero, Vice-Chair Terry Michels, Secretary Wade Clark, Treasurer Ed Huber, Mike Brant, Doug Schwab, Cheryl Sherman, Andy Vick, Sandi Saville, Lee Schwartz, and Tony Ottaviani.


 

 


 

Members Absent: Carolyn Neely, and Ron Shaffer.


 

 


 

Guests in attendance: Ed Mullaney, Kathy McKenney, and Jay Oliver.


 

 


 

The minutes of the November 10, 2011, meeting were read and approved.


 

Chairman Romero approved with Board agreement.


 

 


 

Communications


 

Payment needed for Arts Council invoice from September owed by DDC. Invoice was given to Ed Mullaney for payment responsibility. We will need to determine what line item this expense should come out of before payment is completed. Ed Mullaney will take care of this.


 

 


 

Old Business


 

Wade Clark reported on street vendor requirements from November’s DDC meeting with Dave Umling. The current governing DDC documents contain street vendor requirements. The Board recommends that Dave Umling read the following documents to become aware of the current requirements:


 

DDC Bylaws, Charter Amendment Resolution Numbers 69 and 80, DDC Special Events Guidelines, and the Cumberland Mall Rules & Regulations.


 

 


 

Once Dave Umling has read all documents DDC will work with him and any recommendations he may have to improve current requirements.


 

 


 

New Business


 

Discussion pertaining to distribution of DDC minutes to primary and secondary tax payers (stakeholders). It is recommended by the Board to post DDC minutes on the current City Of Cumberland DDC web page. Carolyn Neely will email stakeholders once minutes are available for each month. Wade Clark will talk to IT person about posting DDC’s governing documents on the City’s DDC web page.


 

 


 

Parklet Pool collections this year will go to promotion line item of DDC’s budget.

Downtown Development Commission Minutes

Motion made by Doug Schwab second by Sandi Saville to form a committee of DDC members to review the future direction of the DDC. The committee will review vision, mission, who we are and who and what we want to be within the parameters of the DDC governing documents. 


 

A budget of up to $1,000 will be allotted (if allowed by City Attorney) for a brain storming session for above purpose. Andy Vick will take the lead to coordinate the weekend multi hour session. 100% vote of agreement


 

 


 

There are two signs in the downtown area that could use some work or be removed. Ed Mullaney will try talking to the business owners before DDC pursues other avenues to alleviate the eyesores.

The financials look good once line number 017-105-70000 is understood to be the one-time pay out to eliminate one bond the DDC voted to pay off.


 

The income is down by $7,000 compared to last year’s budget.


 

 


 

Mall Manager by Ed Mullaney:


 

This year’s tree lighting was a record crowd


 

Midnight Madness will be on December 15 and expecting a great crowd as most stores open.


 

Holiday activities are ongoing from now until Christmas


 

Ed would like to see the buildings that do not look up to par with rest of the town to be addressed and a request made to the owners to clean up the premises.

EXECUTIVE SESSION MINUTES – December 8, 2011


 

 


 

Motion made by Lee Schwartz and seconded by Doug Schwab to go into executive session at 8:22AM on December 8, 2011.


 

 


 

City Market Consultant report was discussed (Franpoint). Committee recommends to the DDC that we put the project on hold at this time. Perhaps the economic environment will change and the City Market will become a viable project. The DDC will continue to monitor the economic conditions of the downtown looking for the right time to proceed with the City Market Project.


 

Motion made by Andy Vick and seconded by Mike Brant to accept the recommendation of the City Market Place Committee. 100% vote in agreement.

THE DRAFT NEIGHBORHOOD ELEMENT OF THE 2013 COMPREHENSIVE PLAN IS NOW AVAILABLE FOR PUBLIC REVIEW

 

The Draft Neighborhood Element (Volume I) of the 2013 Comprehensive Plan has been posted on this page for public review and comment.  This draft element is the first of two documents that will ultimately comprise the 2013 Cumberland Comprehensive Plan  In addition, you can access the Public Comment Matrix, which lists all of the public comments that have been formally received to date regarding the draft element.  Please be advised that hard copies of these documents are also available for public inspection at the Washington Street and South Cumberland public libraries and at the Community Development office in the basement of Cumberland City Hall.

 

The first public hearing on this plan has been scheduled by the Planning Commission and will be conducted at 4:00 PM on Monday, September 12, 2011 in the Mayor and Council Chambers on the 2nd floor of Cumberland City Hall at 57 North Liberty Street.  Citizens and interested parties who wish to present formal comments on the draft element to the Planning Commission are encouraged to attend this hearing.  In addition, formal written comments may be submitted to David Umling, City Planner, at 57 North Liberty Street, Cumberland MD  21502, or by e-mail at dumling@allconet.org.  All written comments intended for the Planning Commission hearing record must be received prior to the public hearing time or presented at the public hearing.  If you should have any questions about the draft element or the public hearing, please call 301-759-6503.

This project includes the mill and overlay Baltimore Street (from Park Street to Waverly Terrace), the reconstruction of Baltimore Street (from Waverly Terrace to Ridgeway Avenue), the mill and overlay of Bedford Street (from the north end of the McMullen Bridge to Henderson Avenue), and the mill and overlay of Frederick Street (from Mechanic Street to Centre Street).  This project involves the following approximate quantities: 6500 square yards (SY) of Milling, 826 tons of 2” Hot Mix Asphalt Surface Course, and 6800 square yards (SY) of Continuous Paving Fabric. In addition, the project will include installation of pavement markings and contingent quantities of curb, sidewalk, and other items.

Local Bid Preference may be provided to vendors and contractors per Section 2-175 of the City Code as follows:

 

Sec. 2-175. - Local preference in the awarding of contracts requiring competitive bid.

 

(a)    In any instance where competitive bidding is required pursuant to the provisions of sections 2-171(a) or 2-173 and the contract is completely funded by the city, without contribution, in whole or in part, from any third parties, unless preference percentages are otherwise established by the mayor and city council, an award shall be made to a vendor resident in the city, provided that such bid does not exceed the lowest qualified bid from a nonresident vendor by more than seven (7) percent of the latter bid and that such resident vendor has made written claim for such preference at the time that bid was submitted and except when, in the judgment of the mayor and city council of Cumberland the granting of said preference would operate to the disadvantage of the city. In the event that no award is made to a vendor resident in the city pursuant hereto, then, and in that event, an award shall be made to a vendor resident in the county, provided that such bid does not exceed the lowest qualified bid from a nonresident bidder by more than five (5) percent of the latter bid, and that such resident vendor has made written claim for such preference at the time the bid was submitted, and except when, in the judgment of the mayor and city council of Cumberland, the granting of such preference would operate to the disadvantage of the city.

 

(b)    A vendor shall be deemed to be a resident of the city if it maintains an active bona fide place of business within the city and, in the case of a corporation or other association which is required to register with the State of Maryland in order to do business therein, it is duly qualified to do business and is in good standing under the laws of the state.

 

(c)    A vendor shall be deemed to be a resident of the county if it maintains an active bona fide place of business within the city and, in the case of a corporation or other association which is required to register with the State of Maryland in order to do business therein, it is duly qualified to do business and is in good standing under the laws of the state.

 

(d)    The preferences provided to residents of the city and county provided under this section shall be deemed to be waived unless a vendor seeking the benefit of those provisions certifies under the penalties of perjury that it is qualified as a resident vendor under the terms of subsections (c) or (d) above and said certification is included in the vendor's bid submissions.

 

(e)    In any instance where the provisions of any federal or state grant which might be utilized to fund any purchase pursuant to the provisions of sections 2-171(a) or 2-173 require it to be made upon competitive bid, and if the regulations of such federal or state grant prohibit the mayor and city council of Cumberland from acting as contemplated herein, the provisions of this section shall be considered to be without effect as to that particular instance, but shall remain applicable to all instances not involving such federal or state grants and regulations.
